Health Law The firm's health law practice includes representation of over one dozen tribally operated health facilities. The firm's understanding of the tribal health system enables us to effectively apply general health law principles in the unique tribal health setting. The firm actively monitors and participates in the development of both state and federal health care legislation and regulations and counsels clients with respect to both compliance and strategic planning in response to new or proposed legislation. The firm also has extensive experience representing tribal entities undergoing Medicare and Medicaid audits and investigations, and in negotiating successful settlements of those investigations.
In addition, the firm provides counsel on credentialing, peer review, medical staff bylaws, meeting JCAHO standards, implementation of risk-management initiatives, dealing with excluded providers, and planning and making voluntary disclosures and/or repayment to federal and state programs. The firm has assisted compliance officers with policy review and development in areas such as the Emergency Medical Treatment and Active Labor Act (EMTALA) and the Health Insurance Portability and Accountability Act (HIPAA), and has assisted with internal compliance investigations and developing compliance programs. The firm has experience in interpreting Medicare and Medicaid rules, including Stark and anti-kickback rules, and in applying those rules to physician/hospital agreements, and also regularly advises clients on Indian Health Service regulations and related eligibility issues.
